Both the European Banking Authority (EBA) and the European Securities and Markets Authority (ESMA) have called for EU level regulation on cryptoassets and ICOs this week. In a report published Tuesday, the EBA stated that cryptoasset related activities do not fall under existing EU law and that rules need to be put in place to protect investors. A report from the ESMA provided guidance to the EU’s Commission, Council, and Parliament on the existing rules that could be applied to cryptoassets, including where some assets could fit into the existing MiFID framework.
